Bryan Epis Released from Prison

In prison since his 2002 conviction, Brian Epis was released this week. A federal appeals court has ordered him released while he's appealing his 10-year sentence for growing medical marijuana.
His appeal hinges on Raich v. Ashcroft, a case partially funded by the Drug Policy Alliance and pending before the United States Supreme Court. In the Raich case, a lower court has ruled that the federal government cannot interfere with medical marijuana patients and caregivers when they are following state law.
Epis has also argued that his conviction was unconstitutional and based on prosecutorial misconduct. He says prosecutors misrepresented spreadsheets they found on his computer, alleging he was conspiring to grow more than 1,000 marijuana plants. He was arrested in 1997.
Epis' 11-year-old daughter Ashley told Americans for Safe Access she misses her father and can't wait to have him home.
